ELITE CLUB TERMS AND CONDITIONS

These terms and conditions (this "Terms") govern the use of the ILI POT Elite Club ("Elite Club") membership. Any individual who wishes to sign up for ILI POT Elite Club ("you," "your," "yours," "Member") must agree to be bound by these Terms and Conditions, as varied from time to time.

DEFINITIONS

To simplify this Terms for you, the following definitions will apply:
"ILI POT Elite Club" means a loyalty and rewards programme which is operated by ILI POT Delivery.
"Member" means an individual who has successfully registered under the ILI POT Elite Club Membership.
"Account" means the record of Membership details that consists of Elite Point record, membership level, transaction history, and personal details.
"Rewards" refers to the benefits offered to Members upon registration of ILI POT Elite Club.
"Personal data" is the data or information that can be used to identify an individual and is as defined under the Personal Data Act 2010.
"ILI POT Delivery Website" or "the Website" refers to www.ilipot.com.my.
"Elite Point" means the points earned by a Member by making purchases at ILI POT Delivery Website.

 

  1. MEMBERSHIP AND GENERAL TERMS/CONDITIONS

  1. By signing up for ILI POT Elite Club membership or by retaining, using or authorizing the use of the Elite Point, all of the personal information provided by you to us is true, accurate, correct and complete; you acknowledge and agree that in order for us to provide the services and Rewards under the ILI POT Elite Club to manage your Elite Point and the Account, and to enable you to participate in the ILI POT Elite Club, the sharing, retrieval, updating and processing of your Personal Data as well as the creation of member profiles and user accounts and updating of personal details will occur between ILI POT Delivery, our affiliates, partners and any third party contractor, service provider or agent in connection with the provision of the Elite Point and ILI POT Elite Club services and you have hereby consented to the same; and that you have hereby read, understood and accepted all the terms and conditions contained in this Agreement and our Privacy Policy and in connection with the use of the Elite Point, and that they are binding on you without any exception.

  2. To participate in the ILI POT Elite Club, individuals must have a valid mobile number and a valid email address.

  3. Membership registration can be done at ILI POT Delivery Website for free.

  4. Each individual is allowed one (1) time to sign up only.

  5. Members are responsible for maintaining the secrecy of their password and username, for all activities that occur using their password and for notifying ILI POT Delivery of any unauthorized use of their password. ILI POT Delivery is not responsible in any way for any loss arising from unauthorized use of a Member’s password.

  6. To the maximum extent permitted by law; i)ILI POT Delivery does not guarantee or warrant that any or all of the Rewards of the ILI POT Elite Club will be available at all times, ii)ILI POT Delivery reserves the right to change, modify, limit or cancel any of the Rewards at any time and this includes increasing or decreasing any requirements for a Reward, changing the value of Rewards or limiting the availability of Rewards.

  7. Elite Club Account and Rewards:

    1. Are non-transferable. Only the Member can use their respective account and the Rewards at all times;

    2. May not be purchased, and

    3. Are not redeemable for cash under any circumstances unless required by law. Accumulated Rewards do not constitute property of the Member, nor are accumulated Rewards transferable by the Member upon death, as part of a domestic relations matter or otherwise.

2. BENEFITS OR REWARDS

  1. For online purchase, Members need to log in to their Account on the Website during purchase of any ILI POT Delivery products in order to be entitled for earnings of Elite Points. Members will earn Elite Point for every successful purchase made online via Website unless otherwise stated. 

  2. For offline purchases, a member who makes an order without using his/her member account will not be entitled to the collection of Elite Points unless stated otherwise.  

  3. Elite Point will not be earned from the following:

  • Cash vouchers

  • Events booking

  • Bulk vouchers/tickets purchase from corporate sales; or

  • Any transaction that doesn’t incur any monetary value, ie RM0 transactions;

  • Any transaction made through corporate sales

  1. Elite Point is earned from the total cart value of the purchase made by Member and can be used to enjoy special rewards offered by the Elite Club. 

  2. Elite Points are valid for approximately 10 months from the date of each transaction based on the expiration rate of 10% for each 30 days from the date of Elite Point accumulation. (eg: 200 Elite Points will decline to 180 after the first 30-days and so on until the total sum is depleted) 

  3. There will be no decimal points calculated in calculation of the Elite Point and all Elite Points will be rounded accordingly before being reflected in each Member’s Account. 

  4. ILI POT Delivery shall not be responsible in any way whatsoever for the use or redemption of Rewards from an Account that has been lost, stolen or otherwise used without Member's permission.

3. PERSONAL DATA

  1. Members consent and agree to:

  1. Co-operate and comply with all reasonable requests of ILI POT Delivery in connection with ILI POT Elite Club;

  2. Disclose personal data to ILI POT Delivery for the purpose of organizing, promoting, facilitating, conducting or handling any matters relating to ILI POT Elite Club;

  3. The sharing, transfer, retrieval, updating and processing of their personal data as well as creation of their member profile and user accounts which will occur between ILI POT Delivery, its affiliates, partners and any third party contractor, service provider or agent (within and beyond Malaysia) in connection with the provision of services for ILI POT Elite Club in order to facilitate the provision of services and Rewards related to ILI POT Elite Club; and

  4. Receiving promotional, marketing and other publicity information from ILI POT Delivery and/or its partners from time to time. The personal data provided by the Member is subject to and will be handled according to the ILI POT Delivery Privacy Policy, available at www.ilipot.com.my.

  5. The processing of their personal data in accordance with ILI POT Delivery’s Privacy Policy notice pursuant to the Personal Data Protection Act 2010.

b. Members hereby agree to submit and maintain accurate and current user data in connection with their Memberships. Such information includes name, address and mobile number. Members can update their Account information by clicking the edit profile feature at the Website.

4. TERM AND RENEWAL

The Membership term is life-long from the date of purchase.

5. DISCLAIMERS; LIMITATION OF LIABILITY

  1. YOU ACKNOWLEDGE AND AGREE THAT APART FROM WHERE REQUIRED BY LAW, THE USE OF THE ILI POT ELITE CLUB AND ANY OF ITS ASSOCIATED REWARD IS AT MEMBER’S SOLE RISK WHEREBY THE MEMBERSHIP REWARD ARE PROVIDED ONLY ON AN “AS IS” AND “AS AVAILABLE” BASIS.

  2. YOU ACKNOWLEDGE AND AGREE THAT APART FROM WHERE REQUIRED BY LAW, ILI POT DELIVERY AND ALL OF ITS AFFILIATES, DIRECTORS, OFFICERS AND AGENTS (COLLECTIVELY "MEMBERSHIP PROVIDERS") EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

  3. ILI POT DELIVERY AND/OR MEMBERSHIP PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF MEMBERSHIP PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM (i) THE USE OR THE INABILITY TO USE THE ILI POT ELITE CLUB OR ANY REWARD THEREOF; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED VIA THE USE OF THE ILI POT ELITE CLUB; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF MEMBER'S ILI POT ELITE CLUB DATA; OR (iv) ANY OTHER MATTERS RELATING TO THE ILI POT ELITE CLUB INCLUDING (WITHOUT LIMITATION) ANY CANCELLATION, SUSPENSION, POSTPONEMENT OR TERMINATION OF THE MEMBERSHIP BY ILI POT DELIVERY.

  4. To the maximum extent permitted by law, ILI POT Delivery is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorised access to, or alteration of, user or member communications, or any problems or technical malfunction of our telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.

6. EVENTS OF DEFAULT

  1. To the maximum extent permitted by law, We may suspend, block, revoke and/or terminate a Membership of ILI POT Elite Club without notice and for any reason notwithstanding that we may have waived our rights on some previous occasion upon the occurrences of any or more of the following events, including but not limited to:

  2. If you provide any misleading, false or incomplete information or makes any misrepresentations to ILI POT Delivery or to any of its partner in connection with the ILI POT Elite Club; or

  3. If you abuse any privilege or Rewards accorded to the Member under the ILI POT Elite Club or using the ILI POT Elite Club for profit; or

  4. If you use your Account for any unlawful or fraudulent activities; or

  5. If you post Member's directed promotional offers or coupons or your Membership number on websites or reproduce for use by third parties or public websites; or

  6. If you are deceased or declared bankrupt; or

  7. If you display inappropriate behaviour against any member of ILI POT Delivery staff; or

  8. If payment of any sum of money is due from you to us at any time under the Account; or

  9. If you commit or threaten to commit a default or breach of any agreements, covenants, terms or conditions under this Agreement or in any of your transaction with us online; or

  10. If we have noticed irregular, suspicious or unauthorized activity on your Account; or

  11. If an event or events has or have occurred which should in our opinion prejudice your ability to perform your obligations under this Agreement or would otherwise be harmful to our interests.

  12. In such circumstances, any accumulated Elite Points and Rewards earned shall be forfeited and we reserve the right not to refund any amount or balances existing in the Account. Further thereto, we reserve the right to take any action against you as may be deemed necessary or required under the governing laws or by the relevant governing authorities. We may terminate or alter any or all of the Rewards available under ILI POT Elite Club at any time with or without notice. For any voluntary cancellation of membership by the Members, the Members will not be able to reactivate the Account but are eligible to open a new Account without the benefit of the previously accumulated balance.

7. GOVERNING LAW

This Agreement, and the respective rights and obligations of the parties hereunder, shall be governed by the laws in force in Malaysia. You irrevocably submit to and accept the exclusive jurisdiction of the Courts of Malaysia.

8. ACKNOWLEDGEMENT

This Agreement, including all documents referenced herein, represents the entire understanding between us and any user of the ILI POT Elite Club and supersedes any other agreements, statements or representations unless otherwise stated. Headings used in this Agreement are for reference only and shall not affect the meaning of any terms. Any use of any portion of the ILI POT Elite Club is deemed to have accepted the terms and conditions of this Agreement.

9. CHANGES TO THIS AGREEMENT

We may change the terms and conditions of this Agreement at any time without prior notice or liability by posting a revised Agreement on the Website accordingly and appropriately. Any such change shall take effect immediately upon posting, unless otherwise provided. You may view the current version of this Agreement at any time online. For this reason, we strongly recommend that you review the terms and conditions whenever you use the Account and/or the Reward.
